1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the Polygon Motors GW website and auction platform (“we”, “our”, “us”). By registering an account, browsing listings, placing a bid, or completing a purchase, you agree to be bound by these Terms. If you do not agree, please do not use this website.

2. Eligibility and Account Registration

Our marketplace is open to buyers located in Australia, including private individuals and businesses such as contractors, farmers, dealers, and fleet operators. To bid or purchase, you must create an account and complete identity verification, including a valid government-issued ID. We reserve the right to refuse, suspend, or terminate any account at our discretion, including where fraudulent or suspicious activity is suspected.

3. Nature of Listings

All vehicles and equipment listed on this platform are bank-repossessed assets sold on an “as-is, where-is” basis. Listings include independent third-party inspection reports, photographs, video walkarounds, and PPSR (Personal Property Securities Register) reports where applicable. Buyers are strongly encouraged to review all available listing information before placing a bid.

4. Auctions and Bidding

• All auctions run on a no-reserve basis — the highest bid at the close of the auction wins.
• Bids are placed manually and are final, binding, and cannot be withdrawn or cancelled once submitted.
• If a bid is placed within the final minutes of an auction, the auction time may be automatically extended to prevent last-second bidding (anti-sniping protection).
• Selected listings may include a Buy Now option, allowing immediate purchase at a fixed price, which closes the auction instantly.
• By placing a bid, you confirm that you are financially able and willing to complete payment at that price if you win.

5. Payment

All transactions are conducted in Australian Dollars (AUD). Payment is accepted via bank wire transfer only; we do not accept PayPal, credit cards, personal cheques, or other payment methods. Payment is due within 24–48 hours of winning an auction. Failure to complete payment within the specified timeframe may result in forfeiture of the item and suspension of your account. No buyer premiums, commissions, or hidden fees are added to the winning bid price.

6. Delivery

Delivery is coordinated and managed by our logistics team from the secure storage facility to your specified address. Personal pickup is not available, as all assets are held in restricted-access facilities under the custody of financial institutions. Delivery timeframes and any applicable delivery fees are outlined on our Help Center / FAQ page and confirmed at the time of purchase. All shipments are fully insured during transit.

7. Inspection Period and Guarantee

Buyers have a 7-Day Inspection Period after delivery to confirm the item matches its listing description and inspection report. If an undisclosed mechanical fault or material defect is identified within this period, the item may be returned for a full refund, with return transportation arranged and paid for by us. Every qualifying purchase is additionally covered by a 12-Month Guarantee, valid for up to 12 months, 1,000 operating hours, or 20,000 km — whichever occurs first — covering major mechanical components. Normal wear and tear, routine servicing, fluids, tyres, and other consumable parts are not covered.

8. Limitation of Liability

To the maximum extent permitted by Australian law, Polygon Motors GW shall not be liable for any indirect, incidental, or consequential loss arising from the use of this platform or the purchase of any item, except where such liability cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law that cannot lawfully be excluded.

9. Intellectual Property

All content on this website, including text, images, logos, and design elements, is the property of Polygon Motors GW or its licensors and may not be reproduced, distributed, or used without prior written consent.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or applicable law. Continued use of the platform following any update constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
